Participant Release, Waiver and Consent

The purpose of this Participant Release, Waiver and Consent (“Release”) is to ensure a safe and positive environment by making individuals aware there are regulations and procedures in place for safety, security and expectations for all. The Mat-Su 2024 Arctic Winter Games supports equal opportunities, prohibits discriminatory practices, and is committed to providing an environment in which all individuals are treated with respect and fairness.

I understand there are potential risks of which I may not presently be aware. Because of the risks of participating in this activity, I recognize the importance and agree to fully comply with the applicable laws, policies, rules and regulations, and any Mat-Su 2024 Arctic Winter Games Host Society and Arctic Winter Games International Committee instructions regarding participation in this activity.

All participants, coaches, chaperones, officials and mission staff must have read, understand, consent, acknowledge and abide by the following regulations:

I voluntarily elect to participate in this activity with knowledge of the risk involved, and acknowledging the unknown risks involved, and I hereby agree to accept and assume any and all risks as described in this Release. 

Release of Liability, Waiver of Claims, and Indemnity Agreement

Liability Waiver and Release: In consideration of acceptance of my participation in the Mat-Su 2024 Arctic Winter Games, I waive any and all claims I may have against, and release from liability, and agree not to sue Matanuska Susitna Borough, the Mat-Su 2024 Arctic Winter Games Host Society, the Arctic Winter Games International Committee, and their respective directors, officers, servants, agents, sponsors, employees, volunteers, vendors, contractors and other participants for any personal injury, death, property damage or loss sustained by me as a result of my attendance at and participation in the Mat-Su 2024 Arctic Winter Games arising out of any cause whatsoever including without limitation negligence or breach of statutory duty. 

I agree to indemnify and hold harmless the Mat-Su 2024 Arctic Winter Games Host Society and the Arctic Winter Games International Committee from any and all third-party claims, demands, actions or costs (including legal costs on a attorney-client basis) for which I am legally responsible arising out of any consequence of my attendance and participation in the 2024 Arctic Winter Games.

In entering into this Release, I am not relying on any oral or written representations or statements made by the Matanuska Susitna Borough, the Mat-Su 2024 Arctic Winter Games Host Society, the Mat-Su 2024 Arctic Winter Games Host Society and the Arctic Winter Games International Committee, including those in materials issued to induce me to take part in the 2024 Arctic Winter Games.

Consent Regarding Medical & Personal Information

I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident or illness during this activity or event. This consent, release, indemnification, and waiver, shall be constrained broadly to provide a consent, release, indemnification, and waiver to the maximum extent permissible under applicable law. 

I hereby grant to the Arctic Winter Games International Committee, the Mat-Su 2024 Arctic Winter Games Host Society, and my Contingent organizing body the following rights to collect, use and disclose my personal information given by me during the games:

1.      To collect and use, without payment of any fee, charge, or compensation of any kind, including royalties, any and all written information about me (but not including information given on the Medical Form), for non-commercial promotional purposes, or research purposes and I also agree to waive a right to approve such use or disclosure now and in the future;

2.      To disclose my personal information (including medical), collected during the registration process in GEMS.pro (the 2024 Arctic Winter Games - Games Event Management System), to the Team Chef de Mission, the Mat-Su 2024 Arctic Winter Games Host Society and medical professionals for the continuity of care in the event of injury, medical emergency or an existing condition requiring treatment during the Games;

3.      Information collected during the registration process in GEMS.pro may be stored on servers located in Denmark. For the GEMS.pro privacy policy, please see GEMS.pro privacy policy on the website. To disclose my personal information collected during the registration process in GEMS.pro to the Mat-Su 2024 Arctic Winter Games Host Society medical personnel and, if applicable, to local medical partners, in order for them to provide me with necessary medical treatment I may require while participating in the Games; in compliance with HIPAA, if applicable; 

4.      If I am removed from play for medical reasons, to disclose information pertaining to my removal from play, including the specific medical condition or injury, to my Team Chef de Mission and the Mat-Su 2024 Arctic Winter Games Host Society;

5.      To use or disclose any and all personal medical information about me in an anonymous form only, for the purposes of creating reports and to do statistical analysis of medical incidents among games athletes; and

6.      To use biographical information entered on GEMS.pro on the Mat-Su 2024 Arctic Winter Games and Arctic Winter Games International Committee website for years to come.

Waiver of Rights & Image Release

I agree that any photograph, work expressed by any process analogous to photography, video or cinematographic film (the ‘Work’) produced by, at the request of or under the direction or control of the Arctic Winter Games International Committee, the Mat-Su 2024 Arctic Winter Games Host Society or under its supervision during the Mat-Su 2024 Arctic Winter Games and in which, I or the minor person appear may be used, adapted, altered, cropped, produced, published, republished, distributed to the public, communicated to the public by telecommunication, publicly presented as a cinematographic work, presented at a public exhibition or achieved by the Arctic Winter Games International Committee, the Matanuska Susistna Borough, the Contingents and their representatives, assigns, employees and agents and any person acting under their authority, for any purpose related to departmental programming and its promotion throughout the world and indefinitely including, but not limited to, in any publication, broadcast, posting on the Internet (Web) advertising or display, and I hereby forever release and discharge the Arctic Winter Games International Committee, the Mat-Su 2024 Arctic Winter Games Host Society, the Matanuska Susistna Borough, the Contingents and their representatives, assigns, employees, agents and any person acting under their authority from any claims of any kind arising out of or in connection with the use of the Work, including, without limitation, any and all claims for invasion of privacy and libel as described above.

The Freedom of Information of Protection and Privacy Act

As a result of my application as a participant in the Mat-Su 2024 Arctic Winter Games, the Arctic Winter Games International Committee, the Contingents, and the Mat-Su 2024 Arctic Winter Games Host Society will receive personal information from me. In accordance with the legislative requirements, personal information received from me will be held securely and in confidence and will be used only for the purpose of accreditation, communication, information sharing, promotion, and statistical reporting for the Arctic Winter Games. I consent to those uses listed above.

Participant Code of Conduct

I understand that if I do not submit these completed forms as directed by the Mission Staff of my Contingent, I will not be eligible for participation in the Mat-Su 2024 Arctic Winter Games.

Participants must click on this link, select the form corresponding to their contingent, print a copy, sign it and submit it to their Coach or Chef de Mission. If participants are under the age of 18, they should also have it signed by a parent or legal guardian.

I understand that if I do not submit these completed forms, not later than Jan 14, 2024, as directed by the Mission Staff of my Contingent, I will not be eligible for participation in the Mat-Su 2024 Arctic Winter Games.

By selecting yes on this digital form, I acknowledge ‘yes’ is a digital signature. I, the participant, affirm that I am freely agreeing to this agreement and that I, the participant, agree that I have read this form and fully understand that by agreeing this form I am giving up legal rights and/or remedies which may otherwise be available to me regarding losses I may sustain as a result of my participation. I agree that if any portion is held invalid, the remainder will continue in full force and effect. If the participant is under the age of 18, a guardian’s agreement and acknowledgement are also required.
